Missoula begins refunding some court surcharges

The City of Missoula has a plan in place to issue refunds on some Municipal Court case surcharges. 

Before September 2018, the city of Missoula placed a $25 fee on all charges coming through the city Municipal Court. The Montana Supreme Court ruled that action was illegal on state code cases, but said the fee was still legal on city ones. Now the city of Missoula is going over more than 15 years of records to decide who gets the money back. 

Municipal Court judge Kathleen Jenks says the court is trying to clarify what cases are eligible for surcharge refunds. She says there are forms available online that can be filled out and returned to the court, and court staff will go through each case to determine if a refund is in order. 

"A lot of people get confused about whether cases were cases that involved a surcharge or didn't," Jenks said. "We'll sort through that, and we'll be getting those reimbursements out." 

The surcharge has increased over the years. Jenks says people who are eligible for a refund will receive they amount they paid at the time of the case.
