Barry Beach Files Brief for Appeal

The man given a 100-year sentence for a murder he committed as a minor, is ready to argue his appeal.

Barry Beach's lawyers late Friday afternoon filed their brief with the Montana Supreme Court. On February 4 the Montana Supreme Court will hear an appeal of Beach's 100-year sentence in the 1979 death of Kimberly Nees.

The Supreme Court had asked Beach's lawyers and the Attorney General's office to file briefs stating their case by Monday, January 19. Beach's Attorneys say Beach was a teen at the time of the murder, and legal precedent says teens should not be handed life sentences.

The Montana Attorney General's office says this precedent does not extend to murder cases.

The Attorney General's office told ABC FOX Montana it also planned to file its brief by the close of business today, though since Monday is a holiday, it technically has till Tuesday to file.

Beach confessed to the crime, but has since claimed his confession was coerced.
