Billings Serial Rapist Sentencing Friday

The sentencing for the Billings serial rapist happens Friday.

Prosecutors are seeking 23 life without parole terms, and an additional 40 years, for Toby Griego, after he was found guilty of three rapes and one attempted rape.

Chief Deputy County Attorney Rod Souza says the sentence they're seeking is based on statute, but also on the nature of his crimes and his criminal history. The sentencing will include two witnesses from New Mexico, those involved in the investigation in Billings, and may have statements from the Billings victims. One of the witnesses from New Mexico is Kelley Hollingsworth-Ryals whom we spoke to in April.

"I made it an absolute point not to be a victim,” Hollingsworth-Ryals says. “I felt like something was taking away from me that day and so I didn't ever want that to happen again."

"The defendant's convictions from New Mexico are enhancing convictions for purposes of Montana’s life without parole law,” Souza says. “And so the State has to make a record of those convictions and the underlying circumstances of those convictions."

The State's sentencing memo indicates Griego is a sociopath and can never return to society.

It says the crimes show how Griego grew as a stalker and rapist.

David Duke, Griego's defense attorney, says Griego is considering making a statement during tomorrow's sentencing, but it's entirely his decision. Stay tuned to KULR-8.
