Modesty Creek Road Trial Closes, Waiting on Judge's Decision

The Modesty Creek Road bench trial has come to an end and now the final decision is in the hands of Judge Kurt Krueger.

Prior to closing statements, Anaconda-Deer Lodge County continued to call witnesses to the stand.

The issue at hand is whether Modesty Creek Road is a county road or privately owned.

Since 1981, the gate at Modesty Creek Road near Anaconda was locked.

Land owners claim they locked the gate to stop hunters from going on their property in '81.

But in 2012, county commissioners voted to open the gate, saying the road was owned by the county and has been since the late 1890's for mining reasons.

Now the land owner, Ilija Letica, says he was never notified by the county that a public road was on his property nor was it ever maintained and he wants the gate closed.

Following Friday’s testimony, the court made a trip outdoors to the Modesty Creek Road area.

Court was dismissed and now the decision falls into the hands of the judge who has a certain amount of time before making his decision.

Judge Krueger has put the case under his own advisement and will submit his decision through a written letter at a later date.
