Accused Vandal Will Not Face Hate Crime Charges Locally

Posted: Updated:
KALISPELL -

The man accused of tearing apart All Families Healthcare will not be charged with a hate crime.

Instead, county attorneys are looking at the crime as a business burglary of the Valley's only abortion provider.

Montana statutes dealing with civil rights violations only cover crimes of "malicious intimidation" or harassment relating to civil or human rights.

Co-director of the Montana Human Rights Network Rachel Carroll Rivas says a hate crime touches a whole group of people, and stopping women from getting health care is a hard case to prove under Montana law.

"It doesn't change the fact that this attack has had an effect on the whole community and will result for the time in denying women that basic right," said Carroll Rivas.

Carroll Rivas says that federal authorities are looking at this case and they can go after different charges sometime down the road.

Zachary Klundt, 24, is still behind bars after denying four felonies.
