More Bridger Creek Residents Plan To Sue City

More homeowners in the third phase of the Bridger Creek subdivision plan to sue the city of Bozeman, and the state, after volatile organic compounds leached into their homes from an old landfill.

Eight homeowners sent a Notice of Claim to the city and state Thursday seeking unspecified damages.

They said they lost property values, increased health risks and incurred emotional distress.

The notice claims the city and state were negligent when they operated the old Story Mill Landfill and failed to control the hazardous gases.

The city finished installing mitigation systems in 26 of the 28 affected homes earlier this year, the other two homes decided not to have the systems installed.

In January, seven other residents in the subdivision filed a Notice of Claim against the city.
