Bozeman Candidate Files Voting Record Lawsuit

A Bozeman attorney and state legislative candidate challenged a state law requiring all candidates to be thorough and accurate when talking about their opponent's voting records.

In 2013, the Montana Legislature passed a bill requiring any filed reference to an opponents voting record to include the information the claim is based on. It must also have a signature affirming the claims are accurate.

Republican Matthew Monforton filed a lawsuit against the Montana Political Practices Commissioner, Attorney General Tim Fox and the county attorneys of both Lewis and Clark and Gallatin counties.

In the suit, Monforton said this law is vague and violates free speech.

"The most unfair thing about this law is that the voters are not being allowed to have all the information that they need to make a good decision in this election," said Monforton.
   
Monforton is running for House District 69 in Bozeman against fellow Republican incumbent Ted Washburn

A hearing on the lawsuit if set in federal court in Missoula on February 7.
