Survey Finds Prison has High Rate of Sexual Abuse

Montana State Prison and Department of Corrections officials gave their reactions to a survey, indicating the state prison facility has one of the highest rates of inmate rape and staff sexual misconduct in the country.

M.S.P. Warden Leroy Kirkegard and D.O.C. Director Mike Batista each testified Wednesday morning before a U.S. Department of Justice review panel through video conference Wednesday morning.

The survey, with almost two-hundred responses from M.S.P. inmates, was conducted by the federal D.O.J. from 2011 to 2012 and found 9% of the state prison's inmates reported inmate-on-inmate rape.

The same survey found almost 10% reported staff sexual misconduct.

During Wednesday's testimonies, Kirkegard and Batista said they suspect the staff misconduct could be credited to patrol officers conducting clothed pat down searches, sometimes without the inmates' knowledge.

They also stated the lack of a full staff and technological resources could be a cause for high rates of inmate-on-inmate victimization.
