Judge Dismisses Lawsuit Against ARCO

A Butte-Silver Bow County Judge is dismissing a case filed by residents of opportunity against the Atlantic Richfield Company for allegedly damaging their property through the mining process.

On Monday, Judge Brad Newman in Butte dismissed the case, citing the residents were aware of the mining contaminants before they filed the lawsuit.

The case was filed in April of 2005 by almost 100 residents of Opportunity.

According to court documents, the plaintiffs brought eight claims against Atlantic Richfield and its predecessor, the Anaconda Company.

The claims allege the smelting, mining, and milling operation from 1884 to 1980 released arsenic and other hazardous materials into the air, water, and ground of their properties.
