MT Joins Supreme Court Brief Opposing Federal Gun Regulations

Montana is joining 26 other states and territories in a brief filed in the U.S. Supreme Court to protect a citizens right to buy and sell firearms.

Attorney general Tim Fox announced Tuesday that Montana signed the brief in an attempt to limit the reach the federal government has over gun regulations. The brief relates to a case that challenges whether federal law prohibits people who legally buy a firearm from a licensed dealer, with the intention of then selling that gun to another legal gun owner.

Last January a Ninth Circuit Court of Appeals ruled these types of purchases are illegal under federal law. The Supreme Court has agreed to review the case.

"The federal government wants to circumvent both federal and state law to prohibit Americans from selling firearms to other Americans who can lawfully possess them. I'm pleased to join my fellow state Attorneys General in that effort," Fox said.

Oral arguments in the case are scheduled for January 22, with a decision to come by June.
