David Day Changes Plea

KALISPELL -

The Evergreen man who allegedly pushed his neighbor down the stairs to his death is now pleading guilty to negligent homicide as part of a plea agreement with the state.

David Day appeared in Flathead County District Court October 24.

While on the stand, he admitted to being intoxicated the night of June 1, when he punched his neighbor, Gerald Payne, in the back, causing him to fall down the stairs of Day's second floor apartment in the Montana Village.

Payne died due to injuries from the fall.

Day said he struck Payne because he would not leave.

At maximum, Day could serve twenty years in prison.
