Man Pleads Not Guilty To Bozeman Shooting

The man who is accused of shooting three men, killing one says he's not guilty.

The man accused of shooting three men last month at a house party pleaded not guilty to two counts of attempted deliberate homicide and one count of deliberate homicide in court on Tuesday.

25-year-old, Cody Christopher Little appeared in Gallatin County District court with his defense attorneys by his side as he pleaded not guilty to shooting three men at a house party on September 20, two in the leg, one in the stomach. Larry "LJ" Clayton passed away after sustaining injuries from the shooting.

"You would expect the defendant to plead not guilty at this point and that we would start the normal process of both sides exchanging information with the other," said Marty Lambert, Gallatin County Attorney.

Initially Little was charged with two counts of attempted deliberate homicide and one count of assault with a weapon. Lambert decided to change those charges after Clayton died.

Also in court, the defense asked that four people on the witness list be able to have contact with Little. Judge Holly Brown said Little will be able to contact his sister and his girlfriend, but not his two roommates.

"These two witnesses today were not there that night, so I think that was appropriate for the defense to ask for," said Lambert. "The no contact does not apply for his attorneys or his investigators. They still have the ability to talk with them to help put together the defense."

If convicted Little could serve three consecutive life terms in prison.

"Deliberate homicide carries 100 plus 10 for use a weapon. Attempted deliberate homicide is the same sentence that's two counts so 200 plus 20 for use of a weapon.," said Lambert.

Little's bail remains at $1.25 million. His omnibus hearing is set for December 17 at 1:30 p.m.

Lambert said James Armstrong, one of the victims shot in the leg will probably lose his lower leg.
